Terms of Use

These Terms of Use ("Terms") govern your access to and use of websites operated by Lithium ehf (including lithium.is) and our software applications (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services. Additional terms may apply to specific apps or paid features; those terms form part of your agreement with us where applicable.

1. About Lithium ehf

2. Eligibility

You must be legally able to enter into these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. License and acceptable use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business purposes.

You agree not to:

• copy, modify, distribute, sell, or lease any part of the Services except as expressly permitted;
• reverse engineer or attempt to extract source code except to the extent allowed by law;
• interfere with or disrupt the Services or related infrastructure;
• use the Services for unlawful, harmful, or abusive purposes;
• bypass security or access controls; or
• misrepresent your identity or affiliation.

4. Accounts

Some Services may require an account. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly of any unauthorized use.

5. Purchases and subscriptions

Paid apps, in-app purchases, and subscriptions may be offered through the Apple App Store or other platforms. Billing, renewals, refunds, and cancellations are generally handled by the applicable platform under its terms. Unless required by law, fees are non-refundable once processed by the platform.

6. Intellectual property

The Services, including software, design, text, graphics, logos, and trademarks, are owned by Lithium ehf or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Services.

7. User content

If you submit content through the Services (such as feedback or support materials), you grant Lithium ehf a worldwide, non-exclusive, royalty-free license to use that content solely to operate and improve the Services and to respond to you. You represent that you have the rights necessary to grant this license.

8. Third-party services

The Services may integrate with or link to third-party products. We are not responsible for third-party services, and your use of them may be subject to separate terms and privacy policies.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITHIUM EHF AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).

Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the fullest extent permitted.

11. Indemnity

You agree to indemnify and hold harmless Lithium ehf from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms.

12. Suspension and termination

We may suspend or terminate access to the Services if you violate these Terms or if we discontinue a Service. Upon termination, your license to use the Services ends. Provisions that by their nature should survive will survive termination.

13. Changes to the Services or Terms

We may update the Services and these Terms from time to time. Material changes will be indicated by updating the "Last updated" date. Continued use after changes become effective constitutes acceptance.

14. Governing law

These Terms are governed by the laws of Iceland, without regard to conflict-of-law principles. Courts in Iceland shall have exclusive jurisdiction, except where mandatory consumer protections in your country of residence require otherwise.
